1. About These Terms

These terms of service ("Terms") govern your use of CrewSafe AI, an AI-powered maritime safety knowledge tool operated by SVMS Consultancy Limited, a company registered in Scotland (company number SC514512).

By creating an account or using CrewSafe AI, you agree to be bound by these Terms. If you do not agree, you must not use the service.

2. The Service

CrewSafe AI is a knowledge tool that provides AI-generated answers to questions about maritime safety regulations, Permit to Work procedures, and offshore safety requirements. The service retrieves information from a database of regulatory texts and generates responses using artificial intelligence.

Features include asking safety questions with cited regulatory references, saving Q&A pairs as personal templates, searching the regulatory database, and team-based licensing with company document upload.

3. Important Safety Disclaimer

CrewSafe AI is an informational knowledge tool only. It is not a substitute for competent persons, qualified safety professionals, or official regulatory guidance.

  • AI-generated content may contain errors, omissions, or outdated information. Regulations change frequently and there may be a delay between a regulatory update and its inclusion in our database.
  • You must always verify critical safety information against the original source regulation before relying on it for any Permit to Work, risk assessment, or safety-critical decision.
  • CrewSafe AI does not generate, validate, or approve Permits to Work. It provides knowledge to assist you in building permits within your company's own system.
  • The use of this tool does not reduce or replace the legal obligations of the vessel owner, operator, OIM, master, employer, or any other duty holder under applicable maritime and health and safety legislation.
  • You remain solely responsible for ensuring all safety procedures, permits, and risk assessments meet the requirements of your flag state, classification society, company safety management system, and applicable international conventions.

4. Accounts

You must create an account to use CrewSafe AI. You are responsible for maintaining the security of your account credentials. If you become aware of any unauthorised use of your account, notify us immediately at hello@crewsafe.ai.

If you access CrewSafe AI from a shared workstation on a vessel or offshore installation, you must sign out after each session.

5. Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose.
  • Attempt to extract, scrape, or systematically download the regulatory database.
  • Share your account credentials with others.
  • Circumvent usage limits, rate limits, or access controls.
  • Upload documents you do not have the right to share (for team licensing features).
  • Use the service to generate content that misrepresents the status of a safety assessment or permit.
  • Reverse-engineer, decompile, or attempt to extract the source code of the service.

6. Subscriptions and Payment

CrewSafe AI offers a free tier with limited daily questions and a paid Pro tier with expanded access. Pricing is displayed on the service and may change with reasonable notice.

  • Subscriptions are billed in advance on a monthly or annual basis through Stripe.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No partial refunds are given for unused portions of a billing period.
  • If payment fails, we may suspend access to Pro features until payment is resolved.
  • We reserve the right to change pricing with at least 30 days' written notice. Existing subscribers will be notified before any price change takes effect.

7. Team Licensing

Team licensing allows a team leader to upload company-specific documents and invite crew members to access AI assistance tailored to their company's procedures.

  • The team leader is responsible for ensuring they have the right to upload any documents shared through the team licensing feature.
  • Company documents are stored in tenant-isolated storage and are not accessible to users outside the team.
  • We do not claim ownership of any documents uploaded through team licensing.

8. Intellectual Property

The CrewSafe AI service, including its design, code, and branding, is the property of SVMS Consultancy Limited.

Regulatory texts included in our database are sourced from publicly available international conventions, national regulations, and industry guidelines. We do not claim copyright over the original regulatory texts.

You retain ownership of any documents you upload and any templates you create. You grant us a limited licence to process your uploaded content solely for the purpose of providing the service.

9. Limitation of Liability

To the maximum extent permitted by law:

  • CrewSafe AI is provided "as is" and "as available" without any warranty, express or implied, including but not limited to warranties of accuracy, completeness, fitness for a particular purpose, or non-infringement.
  • We do not warrant that AI-generated content will be accurate, complete, current, or error-free. Maritime regulations are complex and subject to interpretation.
  • We shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service, including but not limited to damages arising from reliance on AI-generated content for safety-critical decisions.
  • Our total liability for any claim arising from or relating to the service shall not exceed the amount you have paid us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

10. Indemnification

You agree to indemnify and hold harmless SVMS Consultancy Limited, its directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the service, your breach of these Terms, or your violation of any third-party rights.

11. Termination

We may suspend or terminate your access to CrewSafe AI at any time if you breach these Terms or engage in activity that we reasonably believe is harmful to the service or other users.

You may close your account at any time through the settings page or by contacting us. Upon account closure, your personal data will be handled in accordance with our Privacy Policy.

12. Service Availability

We aim to provide a reliable service but do not guarantee uninterrupted availability. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We recognise that many users operate in environments with limited connectivity and have designed offline features accordingly.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email or notice within the service at least 14 days before they take effect. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of Scotland. Any disputes arising from or relating to these Terms or the service shall be subject to the exclusive jurisdiction of the Scottish courts.
